Italy Traffic Fine Check

Charged for damage after returning a rental car in Italy

A debit weeks after the trip, for a scratch nobody showed you. The company has to show that the damage exists, that it arose during your rental and what it costs. A few documents decide most cases.

Who has to prove what

Under Italian law the hirer answers for deterioration that happens during the hire, measured against the state described at the start. Whoever claims a sum must prove the facts behind it: here the damage, when it arose and what the repair cost. The European Consumer Centres tell consumers to ask for a repair certificate or invoice.

The four checks

A return report signed by the staff with no new damage describes the state in which you gave the car back. Damage already written on the pick-up report was there before your rental. A charge with no damage report, no dated photos and no repair invoice is not documented. And where your contract sets an excess, the part of the charge above it is not covered by the agreement unless the contract excludes the damaged part or the company alleges a breach of the terms.

Returned out of hours

With a key drop, most contracts keep you responsible until the staff inspect the car, so damage found at the inspection is hard to separate from damage caused later. Your own dated pictures from the moment you parked the car are the evidence that counts.

Your card

For a card issued in the EU or EEA you can ask your bank for a refund within 8 weeks of a debit whose exact amount you had not approved in advance; the outcome is uncertain. Outside the EU and EEA, card issuers have their own dispute procedure with their own deadlines. A refund by the bank does not end the matter: the company can still claim the amount, so the written complaint with your evidence comes first.

Where to get help

The European Consumer Centre of your country helps residents of the EU, Norway and Iceland free of charge with cross-border complaints. The European Car Rental Conciliation Service handles cross-border rentals booked directly with a participating company, after the company's final answer and within 12 months. If you have separate excess insurance, claim there too: the insurer needs the company's damage report and the repair invoice.

Frequent questions

Is there a deadline for the company to claim damage?

There is no legal deadline. The longer the gap between the return and the claim, the harder it is for the company to show that the damage arose during your rental and not afterwards. Ask when and by whom the damage was recorded.

They added a handling fee on top of the repair.

A fixed sum out of proportion to the work involved can be an unfair clause under the Italian Consumer Code. The Competition Authority's decisions of 2024 concern the fee for fines and tolls, so for a damage fee the argument is by analogy.

My bank refunded me. Is it over?

Not necessarily. The refund moves the money back; it does not decide who is right. The company can still claim the amount, debit the card again or pass the claim to a collection agency. Keep your written complaint and your evidence.
